The Illinois Residential Real Property Transfer on Death Instrument (TODI) Act, P. A. 97-0555, effective for decedents dying on or after January 1, 2012, creates a new method for transferring Illinois residential real estate without the need for probate.   

The new Act, a joint product of the ISBA Trusts and Estates Section Council, the ISBA Real Property Law Section Council, and the Elder Law Section Council, was initiated under the leadership of ISBA President John O'Brien.

Various methods were implemented in the Act in an attempt to protect the public from potential abuses, and the requirements for execution of a valid Transfer on Death Instrument (TODI) in Illinois are unique. Charles Brown will address the execution requirements which apply to this new non-testamentary method of transferring property at death, recording requirements, revocation requirements, when a beneficiary acquires an interest in the subject property, and the issue of creditors' rights. 

Charles G. Brown has worked on this project from its inception, and brings his knowledge and expertise to bear to provide a comprehensive understanding of this new and important legislation.
