This course provides a broad overview of Illinois land trust law and administration. It covers the various, well-established uses for the land trust (privacy, estate planning, liability protection), as well as new and emerging uses (title fraud protection). It also discusses the legal instruments involved in establishing and administering a land trust, focusing on attorney drafting considerations. In addition, it covers the legal relationships between the parties to the trust, including the trustee, primary beneficiaries, contingent beneficiaries, as well collateral assignees. The course includes both a legislative and case law update, focusing on both recent legislation and case law involving the Illinois land trust.

David Lanciotti

David joined the Chicago Title Land Trust Company in 2001 and serves as Executive Vice President and General Counsel. His responsibilities include oversight of all aspects of the company, including trust operations and administration, business development, as well as all corporate legal and regulatory matters.

He is licensed to practice law in the State of Illinois and in Federal District Court for the Northern District of Illinois. Mr. Lanciotti is a past President and current Board Member of Land Trust Council of Illinois. He is also the author of Land Trust Administration in Illinois (IICLE 2009) and Modern Land Trust Practice (IICLE 2015). He has been retained to provide expert witness testimony relative to the construction, interpretation and administration of land trusts. In addition, he is a board-certified Continuing Legal Education Instructor and a frequent speaker at legal and ban king seminars on land trust issues.
